The subject of research in the paper is the determination of the existence of the right to water as a basic human right. In the context of looking at the above-mentioned right at the universal level, an analysis of relevant acts of a declarative nature, as well as international agreements in the field of environmental protection, was carried out. Special attention is paid to the provisions of international instruments for the protection of human rights, the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention on the Elimination of All Forms of Discrimination against Women and the Convention on the Rights of the Child.
At the regional European level, the subject law was considered from the perspective of the jurisprudence of the European Court of Human Rights. As part of the concluding remarks, the answer to the question of the existence of the right to water as a basic human right, as well as the tendency of the future development of this right, was presented.
